Terms of Service

These Terms of Service (the “Terms”) govern your use of the Listimize web application (the “Application” or “Service”) provided by Listimize (“we”, the “Application Developer”). By creating an account or using the Service, you accept these Terms and the Privacy Policy. If you don't agree, don't use the Service.

1. The Service

Listimize is a software tool for Etsy sellers. It offers features such as keyword and product research, listing SEO analysis and editing suggestions, AI-assisted design, mockup, video and text generation, and viewing shop statistics. Some parts of the Service access your shop through Etsy's official API after you give explicit permission (OAuth).

2. Your account

• You must be over 18 and provide accurate information to use the Service.
• You are responsible for keeping your account and password secure. If you notice unauthorized use, tell us right away.
• You may not transfer or sell your account to anyone else.

3. Connecting your Etsy shop

• You connect your Etsy shop through Etsy's official authorization (OAuth) flow. Your Etsy password is never sent to us or stored.
• The Application accesses only the minimum data needed to provide the Service.
• Any change to your Etsy shop (e.g. updating a title, tags or description, or creating a new listing) is made only when you explicitly approve it. Nothing in your shop is changed without your approval.
• You can remove the connection at any time from within the Application or from your Etsy account settings; your access keys are then deleted.

4. Plans, usage allowances and payment

• Each plan includes a limited daily or monthly usage allowance per tool; some tools are unavailable on the free plan. Paid plans are offered monthly or yearly.
• Daily allowances renew every day and monthly allowances at the start of each calendar month; unused allowances don't carry over. The number of connectable Etsy shops and tracked competitor shops is limited by plan.
• Listimize is solely responsible for billing and collecting fees (including applicable taxes); Etsy has no responsibility in this regard.
• Price changes are communicated to you before they take effect.

5. Acceptable use

When using the Service, you agree to:

• Follow Etsy's Terms of Use, Creativity Standards and Prohibited Items Policy.
• Not copy or infringe other people's products, photos, designs, trademarks or copyrights.
• Publish AI-generated content in line with Etsy's rules, disclosing AI use in your listing where required.
• Not use the Service for spam, fake reviews, manipulating statistics or any unlawful purpose.
• Not attempt to bypass the Service's security, reverse engineer it or overload its systems.

6. AI-generated content

AI outputs (designs, images, videos, titles, tags, descriptions, suggestions) are generated automatically and may be inaccurate, incomplete or similar to others' rights. It's your responsibility to review them before publishing and you are responsible for the content you publish on Etsy. To the extent permitted by law, the right to use the outputs you generate belongs to you.

The Application does not guarantee any particular result, such as increased sales, views or revenue.

7. Intellectual property

The Listimize software, brand, interface and content belong to Listimize. You are granted a limited, non-transferable right to use the Service under these Terms for your personal/commercial shop activities. Content you upload remains yours.

8. Relationship with Etsy

The term 'Etsy' is a trademark of Etsy, Inc. This Application uses Etsy's API, but is not endorsed or certified by Etsy.

DISCLAIMER: THIS APPLICATION IS SOLELY PROVIDED BY LISTIMIZE (THE “APPLICATION DEVELOPER”). YOU ACKNOWLEDGE THAT ETSY, INC. AND ITS AFFILIATES ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE APPLICATION SERVICE, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO THE APPLICATION OR DATA ACCESSED THROUGH IT.

9. Disclaimer of warranties and limitation of liability

The Service is provided “as is” and “as available”. We don't guarantee that the Service will be uninterrupted, error-free or fit for a particular purpose. To the maximum extent permitted by applicable law, Listimize is not liable for indirect damages, lost profits/sales or data loss, and its total liability is limited to the amount you paid for the Service in the 12 months before the claim.

10. Suspension and termination

You can close your account at any time. If you violate these Terms or Etsy's rules, we may suspend or close your account. If we need to discontinue the Service, we will notify users with an Etsy connection at least 30 days in advance.

11. Changes

We may update these Terms from time to time. We announce significant changes by email or in-app notification. Continuing to use the Service after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the Republic of Türkiye. Your statutory rights as a consumer are reserved.
